Affiliate Program Terms & Conditions

By agreeing to join our affiliate program you agree to the following terms and conditions and our community guidelines located here. If you have questions about the language in this agreement, please do not share your affiliate link until all of your questions have been answered. It is up to you to confirm that you understand any and all terms before becoming an affiliate. Reach out to us at mosie@mosiebaby.com if you have any questions. By participating in the Mosie Baby Affiliate Program offered by Mosie Inc. (the “Brand” and referred to as “Mosie Baby”) you, referred to as the “Affiliate” agree to: 

Qualifying Links: You will receive a referral link through Refersion. For us to track visits from your page/post to ours, you must use the html codes we provide you with when linking to Mosie Baby.  All referral links must be do-follow.

Affiliate agrees that: (i) Brand may monitor affiliate’s social media accounts and websites for compliance and reporting purposes; (ii) Brand may use affiliate’s name, nicknames, likeness, and social profile links and/or handles in campaign-related correspondence and post-campaign case studies; (iii) all information related to the services affiliate provides or any information, materials or content are confidential information and ambassador agrees to protect and not disclose it to any third party; (iv) Brand owns and retains all rights to any information, materials or intellectual property owned by them; (v) Affiliate will personally perform all services required; (vi) all affiliate content will be affiliate’s original work and affiliate will not infringe any third party's rights when providing these services; (vii) Affiliate grants Brand a perpetual, transferrable and royalty-free right and license to use any Mosie Baby related content affiliate creates in providing the services for any reasonable purpose in all media forms now known or hereafter introduced/developed (including without limitation in social media); (viii) no employment or similar relationship exists between affiliate and Brand; (ix) Affiliate agrees to, defend, indemnify and hold harmless Brand, and their respective directors, officers, attorneys, agents, employees, service providers and assigns (collectively, "Protected Parties") from and against all claims, liabilities, suits, losses, damages and expenses, including costs and reasonable attorney’s fees, relating to or resulting from (a) Affiliate’s breach of or failure to perform under this Agreement, (b) any violation of applicable law or on any matter related to taxes or fees, or (c) any claims that affiliate’s work violates any rights of any third party; and in no event shall Brand nor any Protected Party be liable for any indirect, punitive, consequential or other similar damages hereunder and Brand and any Protected Party's total cumulative liability under this Agreement shall not exceed the fees paid to affiliate via commissions; (x) Mosie Inc. is not responsible, liable for any medical-related advice or questions that Affiliate answer on their own accord.

No Right of Approval: Affiliate irrevocably waives any and all right to inspect and/or approve Mosie Inc.’s use of their Work and/or Affiliate’s likeness, including without limitation any text, image and/or other creative materials that may be used in connection with the Work and/or Affiliate’s Likeness.

Payment: Commissions will be paid out after 60 days, at the beginning of the following month (if the 1st of the month falls on a weekend or holiday, we would payout the following week), when the return policy period has expired. If a customer returns an order that generated commission fees, we will not include the corresponding fee in your commission payout. Commission is null if affiliate’s link or coupon codes are found on any coupon or discount. Do not share any Mosie Baby coupon codes. Commission is null and void if affiliate is found to be using restricted keywords “Mosie” or “Mosie Baby” on any PPC campaigns. Payments will be made via PayPal. Mosie Baby is not liable for any missed payments due to invalid PayPal email. Affiliate is responsible for keeping their PayPal email up to date within Refersion. Commission is null and void if affiliate is found to be using a nofollow link. Commission is null if affiliate is outside of the United States of America, Canada, the United Kingdom, or Australia. 

Modifications: We may modify any terms and conditions in this agreement at any time in our sole discretion by posting a change notice or a new agreement or by sending a change notice to you by email. Your continued participation in our Affiliate Program following the effective date will be your acceptance of any modifications. 

Termination: We have the right to monitor Affiliate’s site/page/posts to evaluate if Affiliates are following the terms and conditions. We may notify you of any changes that we feel are necessary to make sure that your links to our website are appropriate and we reserve the right to term. Either you or we may terminate this agreement at any time, with or without cause by giving the other party a termination notice.
